MASTER SERVICE AGREEMENT

This Master Service Agreement is between RackBank, an Indian Company incorporated under the Companies Act, 1956 and having its registered office located at 37, Shantinagar, Manoramaganj, Indore, (hereinafter referred to as the “RackBank" which expression shall include its heirs, successors, legal representatives and assignees) and a company incorporated under the respective Companies’ Acts, 1956 and having its registered office (hereinafter referred to as the “Client" this expression shall include his heirs, successors, legal representatives and assignees).

RackBank and Client shall individually be called as “RackBank”, “Client” and collectively called as “Parties”.

The Parties agree as follows:

Each Party acknowledges that Order Processing Form (OPF) shall be confirmed / completed only once both Parties have accepted the terms mentioned in the Service Level Agreement (SLA) and the terms mentioned in Acceptable Use Policy (AUP). This MSA shall include the all the terms mentioned in SLA and will bind both the Parties to all of the terms and conditions mentioned thereof.

This Agreement covers all the terms and conditions with respect to the services detailed in the OPF to be provided by RackBank and to be received by the Client. This Agreement shall supersede all prior oral or written agreements, negotiations, discussions between RackBank and Client.
